Snoika OÜ (hereinafter "we" or "us") is an Estonian entity that provides a B2B SaaS AI marketing platform designed to support businesses with branding, SEO analysis, and fast content production, while also enabling users to validate, test, and pre-sell various business ideas. Our services are intended for both new and established companies (hereinafter the "service").
Since Snoika's activities focus on B2B, most of our customers are other business entities. These privacy terms explain how we handle personal data relating to contact persons and representatives of our clients, as well as individuals who visit our website (hereinafter "you" or "users"), in the course of providing our service or when you browse our website.
Any personal data that is uploaded to, or generated within, our service by our clients is governed by our Terms and Conditions (hereinafter "T&C") and the Data Processing Agreement (hereinafter "DPA") between us and our clients. In those circumstances, our client acts as the data controller, and Snoika serves as the data processor.
Definitions
GDPR refers to the General Data Protection Regulation (EU) 2016/679, applicable across all European Union member states since May 25, 2018.
Personal data means any information related to an identified or identifiable natural person ("data subject"). An identifiable natural person is someone who can be identified, directly or indirectly, by reference to factors such as name, ID number, location, online identifier, or various other attributes specific to their physical, physiological, genetic, mental, economic, cultural, or social identity.
Processing signifies any operation (or combination of operations) performed on personal data, whether automated or otherwise, including collecting, recording, organizing, structuring, storing, adapting or altering, retrieving, consulting, using, disclosing by transmission, disseminating, or otherwise making available, aligning or combining, restricting, erasing, or destroying personal data.
Controller is the entity responsible for deciding the purposes and means of processing personal data.
Processor is the entity processing personal data on behalf of the controller.

The type of personal data we collect and process
Because Snoika operates as a B2B service provider, we collect information that is necessary to communicate with you in your capacity as a representative or point of contact for our client (the company you act on behalf of). This processing is based on our legitimate interest—to communicate and provide services to the company you represent.
Information you provide.
When you use the Snoika service, you may provide details such as your full name, email address, region, job position within your company, language preferences, preferred services, or the industry in which your company operates. You typically provide this data when registering for the service, giving marketing consent, sending feedback, or contacting us in any other manner. If you simply visit our website and are not a user of the service, you may still provide limited personal information such as your name, email address, and company name.

We use cookies and similar technologies (such as web beacons) to collect data automatically from your device. Cookies may be categorized as essential (necessary for the website to function), analytical (used to understand how users interact with our services), or marketing (used to personalize your experience and advertising). If you or your company upload data into our service, that data—including any personal data—remains under the control of our client. Snoika merely processes the data as a data processor to the extent needed to perform the services under the T&C and DPA.
Purposes and legal basis for using personal data
As noted, the primary reason for processing your personal data is to provide services to the client you represent and to communicate with that client. This includes (i) running and maintaining our service, (ii) developing our business (analyzing usage stats, trends, and preferences to improve our offerings), and (iii) marketing our products and services. You can opt out of marketing communications at any time as described under "Your rights."
Our legitimate interest serves as the legal basis for this data processing. If you act on behalf of a legal person, we reasonably assume our processing aligns with the balance of interests and does not violate your rights or freedoms. If you disagree with the processing on this basis, you may object at any time. Should you object, we may request our client to designate an alternative contact person or provide clarification regarding your objection.
For direct marketing relevant to your position or responsibilities at your company, we may occasionally send you direct marketing content if your employer is our client or if you subscribed to our services on your company's behalf. This is also based on our legitimate interest. If you receive such messages, you have the right to opt-out at any time by clicking the link at the bottom of each message.
Sharing your data
Within Snoika, only those employees who need access to your data to perform their duties can view it. Outside Snoika, we may share your data under the following conditions and only to the extent necessary:
- Service providers. Your data may be accessed by third parties (processors) providing services on our behalf, such as hosting, maintenance, billing, marketing, data analytics, or software development.
- Public authorities. We will disclose your data if legally required, for instance to law enforcement agencies, courts, or data protection authorities.
- Legal and financial advisors. We may share your data to protect our rights or property, enforce our contracts, or defend ourselves against legal claims.
- Corporate transactions. We may share your data as part of a business transaction, such as selling our company or assets, issuing new shares to investors, or creating a joint venture, merger, or other corporate restructuring.
Your personal data is generally processed within the European Economic Area (EEA). If a transfer of data outside the EEA is necessary, we comply with the relevant GDPR requirements for international data transfers.
We take appropriate safeguards to protect your data during transfers outside the EEA, such as using Standard Contractual Clauses (SCCs) or other legally recognized mechanisms.
Retention of personal data
We store your personal data as long as necessary for the purposes outlined in this policy or to fulfill legal obligations:
- User account data is maintained while you are active and for up to one year of inactivity.
- Invoicing data and related documentation are kept for seven years, in accordance with our legal obligations.
- Information about any legal transactions between us and our client is retained for the statutory limitation period for civil claims (three years, or ten years for intentional breaches) to protect our legal interests and pursue or defend against claims.
We may continue to use aggregated or anonymized information for analysis or service improvement.
Your rights
Right of access.
You are entitled to know if we process your personal data and, if so, to access it.
Right to rectification.
You may request updates or corrections to your personal data if it is incomplete or inaccurate.
Right to erasure.
You may ask us to delete your personal data in certain circumstances, including where processing is no longer necessary or if it relied on your consent, which you have withdrawn, and no other legal basis applies.
Right to restrict processing.
You can request us to limit the processing of your personal data if certain conditions are met (e.g., you have lodged an objection to processing).
Right to object.
You can object to processing based on our legitimate interest. If you do, we will cease processing unless we can demonstrate compelling reasons or require the data for the establishment, exercise, or defense of legal claims. You also have the right to object at any time to the use of your personal data for direct marketing. Once objected, we will stop such direct marketing.

Right to file a complaint with a supervisory authority

Should you believe we are processing your personal data in breach of GDPR, you have the right to file a complaint with a supervisory authority in the EU Member State of your habitual residence, place of work, or where you believe the infringement occurred.
